2. Terms of sale
2.1 Scope
These terms govern sales of prints made on akiraishi.com (the “Still Life Code” atelier) between the publisher (“the seller”) and anyone ordering as a consumer (“the customer”). Placing an order means you have read and accepted them.
2.2 Products
The customer composes a painting with the Still Life Code atelier (an image computed by a program from a seed and settings), then chooses the medium (poster, fine art print, canvas, frame...), the size and the options offered. The print is made to order from that painting by a print partner. Printed colours may differ slightly from a screen, and the preview shown on the site is a simulation. No limited or numbered edition is promised.
2.3 Prices
Prices are shown in euros, US dollars or pounds sterling depending on the delivery country, before payment, on three lines:
- the painting’s price, set by the artist;
- printing and materials, at the manufacturer’s rate for that product and country;
- delivery, at the carrier’s rate for that country.
The total is what is paid, with no further fees from us. The seller is not subject to VAT (article 293 B of the French General Tax Code), so no VAT is charged. For deliveries outside the European Union, any customs duties, import taxes or clearance fees of the destination country are payable by the recipient. Prices may change at any time; the price that applies is the one displayed when the order is placed.
2.4 Ordering and payment
The contract is concluded on payment. Payment is made by card or the methods offered on Stripe’s secure page, which receives the payment data: this site neither sees nor keeps it. Stripe sends a confirmation email. The seller may refuse or cancel, with a full refund, an abnormal order, a disputed payment or a print that cannot be produced.
2.5 Production and delivery
Each print is produced after payment, at a production site close to the delivery address, then shipped. Production and transit times depend on the product and the country and are indicative. The customer gives a complete, correct address: an order returned because of a wrong address may have to be paid again to be sent out once more. Delivery is offered in the countries on the list shown when ordering.
2.6 Right of withdrawal
In accordance with article L221-28, 3° of the French Consumer Code, the 14-day right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. Each print is made to order from the painting and options the customer chose: it cannot be cancelled or returned after payment, except for a defect as described below. This information is shown before payment, next to the order button and on the payment page.
2.7 Damaged or faulty product
If a print arrives damaged, or has a manufacturing defect or an error (wrong product, wrong size, a print seriously different from the preview), write to leakiraishi@gmail.com within 30 days of receiving it, with the order number and photos. The print will be reprinted or refunded at no cost to you. This is in addition to your statutory rights under the legal guarantee of conformity (articles L217-3 and following of the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), which are not limited.
2.8 Mediation
If a dispute is not resolved amicably, the customer may refer it free of charge to the consumer mediator competent for the seller: Société Médiation Professionnelle, which can be contacted through its website (mediateur-consommation-smp.fr) or by post at: Alteritae, 5 rue Salvaing, 12000 Rodez, France.
2.9 Governing law
These terms are governed by French law. A consumer customer keeps the benefit of the mandatory provisions of the law of their country of residence. Failing an amicable agreement, the competent courts are those provided by law.
3. Privacy policy
The data controller is the publisher named above. Here is what the site does, and nothing else.
3.1 What is collected and why
- When ordering: name, delivery address, email and phone (entered on Stripe’s payment page), country, product chosen, amount, and the painting to print (seed, settings and print file). Purpose: to carry out the order, deliver it, handle complaints and keep accounts. Legal basis: performance of the contract and legal obligation.
- Against abuse: a daily counter tied to an irreversible fingerprint of your IP address (deleted after a day) and, if enabled, a Cloudflare Turnstile anti-bot check. Legal basis: legitimate interest (protecting the service).
- Visit statistics: through Umami, with no cookie and no individual profile.
- Fonts: the site loads Google Fonts, which sends your IP address to Google.
No card data is received or kept by this site. No data is sold.
3.2 Who receives the data
- Stripe, for payment;
- Gelato, to make and deliver the print (name, address, email and phone for the carrier, print file);
- Cloudflare and GitHub, which host the order service and the site.
Some of these providers are located, or process data, outside the European Union (notably in the United States): transfers rely on the safeguards they state (EU–US Data Privacy Framework, standard contractual clauses).
3.3 For how long
- Technical record of the order on the order service: 45 days, without address or contact details;
- print file: 120 days (longer if kept in an archive repository of the site);
- accounting records (payments, invoices): 10 years, as the law requires;
- the rest, at Stripe and Gelato, under their own policies.
3.4 Your rights
You may ask for access, correction, erasure, restriction or portability of your data, and object to processing based on legitimate interest, by writing to leakiraishi@gmail.com. You may also complain to the CNIL (cnil.fr) or to your local data protection authority. Some data (accounting) cannot be erased before the end of its legal retention period.
